1. Application.

These Terms and Conditions of Sale (Terms) apply to all purchases of Fujitsu products (Products) through the Fujitsu General Assist Customer Service Team operated by Fujitsu General (Aust.) Pty Limited (ABN 55 001 229 554) (Fujitsu, we, us, our) in Australia.
(b)
These Terms do not apply to the sale of Products other than as set out in clause 1(a), or by entities other than Fujitsu (including Fujitsu dealers and partners).
(c)
You should read these Terms carefully before submitting an order to us.
(d)
We may amend these Terms from time to time. Amendments will come into effect from the date they are published on our website. The updated version of these Terms will supersede all prior versions. (e)
By placing an order for Products with us you agree to be bound by the version of these Terms in force at the date of your order.
2. Placing Orders
(a)We are under no obligation to accept any order from you and we reserve our complete discretion to decline any order.
(b)
Any order which you place with Fujitsu will only be effective once we have confirmed our acceptance of your order and received successful payment of the price and any other amounts due or, if we notify you of any amendments, once you have confirmed your acceptance of the amended terms as notified to you.
(c)
You are responsible for the accuracy of the information included in your order. We will not be liable to you for any loss you or any third party suffers for delay or failure to process your order or deliver Products due to inaccurate or incomplete details included in an order.
(d)
You represent and warrant that you are over 18 years of age and not under legal disability. We are not able to accept orders from persons under the age of 18.
(e)
If you place consecutive or separate orders, we cannot consolidate your orders. A separate delivery fee, if applicable, may apply to each order.

3.2.
The products and services displayed on the Service may not be available for purchase in your particular country or locality. Except to the extent expressly permitted by these Terms or applicable law, no contents on the Service may be used, copied, modified, translated, distributed or otherwise utilised without the prior written consent of Fujitsu General Australia or the owner of the content.

Trademarks of the Fujitsu General Australia include Mayanwair, Cool Finance, General (logo), Airstage, Airstage Edge Controller, anyWair, FGLair, Fujitsu General Assist, Australia’s Favourite Air, M-Presenter, Weatherstage, Economatch and Nocria,

8. Termination
8.1.
Fujitsu General Australia or you may terminate the Terms at any time. The Terms are effective unless Fujitsu General Australia or you terminate the Terms.
8.2.
You may terminate the Terms by destroying:
(a)
all materials obtained from this Website and/or the Subsites, and
(b)
all related documentation, versions, installations, and copies of the Contents. Fujitsu General Australia may terminate the Terms immediately without notice if, in its sole judgment, you breach any term or condition of the Terms.
8.3.
Upon termination of the Terms, you shall destroy all related materials, documentation, versions, installations, and copies of the Contents.
9. Export Control Regulations
9.1.
Fujitsu General Australia makes no representation that the Contents in this Website and/or the Subsites are appropriate or available for use in the location in which you are situated. Accessing the Contents from territories where its Contents are illegal is prohibited.
9.2.
You agree that by using or accessing to this Website and/or the Subsites, you do so on your own initiative, and you are responsible for compliance with the applicable local laws, rule and regulations. Fujitsu General Australia shall not be liable for direct, indirect, incidental, consequential, punitive, or other damages (including, without limitation, economic losses, lost profits, lost revenues, or lost data) arising out of and/or relating to the access to or inability to access to the service, even if advised of the possibility of such damages.
(E)
Fujitsu General Australia may change and/or alter the any or all Contents of the Service, including, without limitation, its structure, usage conditions, URL, and content or other information, and may suspend or discontinue the Service at any time without any prior notice. Fujitsu General Australia shall not be liable for any damages or losses arising out of and/or relating to any alteration or change of the contents or inability to use the service.

Our services may come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

to cancel your service contract with us; and
(b)
to a refund for the unused portion, or to compensation for its reduced value

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
11. Compliance with Local Laws
Those who choose to access the Service from locations other than Australia may do so on their own initiative and are responsible for compliance with local laws if, and to the extent, local laws are applicable.
12. Applicable Laws and Court of Jurisdiction

14.2.
If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.
